Terms and Conditions

MessageHup, owned and operated by My Dream Soft, provides a SaaS platform enabling customers to create, edit, store, analyze, and send message notifications via WhatsApp’s Cloud API. Before using MessageHup, please thoroughly review and understand these Terms and Conditions.

1. Agreement Overview

This Terms of Service (“Agreement”) is between My Dream Soft (“MessageHup,” “we,” “us,” or “our”) and the entity that registers for an account (“Customer,” “you,” or “your”). By signing up for MessageHup, you acknowledge and agree to these terms on behalf of the Customer.

2. Acceptance of Terms

By using any part of MessageHup, including the website, you confirm that you have read, understood, and agree to abide by these Terms and Conditions. If you disagree with any part of this Agreement, you must immediately stop using the service. You warrant that you have the authority to enter into this legally binding agreement.

3. Service Provision

Subject to compliance with this Agreement, My Dream Soft will provide MessageHup services. This requires the Customer to comply with WhatsApp’s terms, acquire necessary approvals, and ensure interoperability between MessageHup and third-party applications.

5. Trademark License

During the term of this Agreement, the Customer grants My Dream Soft a non-exclusive, non-transferable license to use its trademarks and logos for marketing MessageHup, subject to the Customer’s usage guidelines.

6. Intellectual Property

My Dream Soft retains all rights to MessageHup and related materials. Customers may not copy, modify, reverse engineer, or exploit any part of the service. My Dream Soft claims no intellectual property rights over Customer content uploaded to the service.

7. Customer Data Usage

My Dream Soft may store and use Customer data, including personal data, to provide the service. We may also use aggregated or de-identified data for internal purposes such as analytics and service improvement.

8. Customer Responsibilities

Customers are responsible for maintaining the confidentiality of their accounts and for all activities that occur under their accounts. Unauthorized sharing or use of accounts is prohibited. Customers must notify My Dream Soft of any unauthorized use. Violation of these responsibilities may result in account suspension or termination.

9. Usage Restrictions

Customers must not use MessageHup to transmit harmful, illegal, or inappropriate content. Activities such as unauthorized access, data mining, and use of the service for competitive purposes are prohibited. Customers must comply with WhatsApp’s policies and avoid violations that could lead to account suspension.

10. Support

Technical support is available from 10:00 AM to 8:00 PM IST on weekdays. Support can be accessed via email or the website chat widget.

11. Fees and Payment

Customers must pay the applicable fees as described on the MessageHup website. Fees exclude charges from WhatsApp for using their Cloud API. Payments are non-refundable, and failure to pay may result in service suspension.

12. Limitation of Liability

My Dream Soft liability is limited to the fees paid by the Customer in the preceding 12 months or $200, whichever is lesser. We are not liable for indirect, incidental, or consequential damages.

13. Term and Termination

This Agreement begins on the effective date and continues until terminated. Either party may terminate the Agreement with 30 days’ notice before the end of the current term. My Dream Soft may suspend or terminate accounts for non-payment or violation of terms.
